The legal battle between JGR and Chris Gabehart has further deepened as Gabehart responded to the recent court filings of his former employer. 

Last week, Joe Gibbs Racing filed a petition in the Western District of North Carolina court for expedited discovery to prevent the loss of relevant evidence related to Gabehart's deleted texts with Dickerson.

However, in the most recent filing by Gabehart, it states that he informed the organization of the deleted texts between him and his current employer, Spire Motorsports, and has no problem with the subpoena being issued to his service provider.

NASCAR insider Bob Pockrass shared the updates of the proceedings via his X account. This read,  “Gabehart filing today states he told JGR of deleted texts at the appropriate time & is OK w/subpoena to service provider. JGR’s attempt to weaponize Mr. Gabehart’s voluntary and timely disclosure reflects the punitive nature of this litigation, not any legitimate evidentiary need.”

The JGR lawsuit came after Gabehart decided to part ways with the team and join Spire Motorsports. However, JGR filed a lawsuit alleging that Gabeheart had stolen confidential trade secrets.

The JGR lawsuit keeps getting deeper as Gabehart has now called out Joe Gibbs Racing for filing a subpoena of other teams such as Haas, Trackhouse Racing, and RWR. 

Gabehart, in his argument, stated that JGR should not be allowed to subpoena the other teams, as there was no evidence that he shared any confidential information with anyone, not even Spire. 

The tweet shared by Bob Pockrass read, “Gabehart filing today also reiterated stance that JGR shouldn't be allowed to subpoena Haas, RWR and Trackhouse owners/execs b/c no evidence Gabehart gave any JGR info to Spire, let alone anyone else.”

What gives JGR a motive to push for all these filings is the auto-delete text feature that was being used by Dickerson in his conversation with Gabehart. The feature has overtime deleted messages that, according to Joe Gibbs, could have been crucial. 

While the final verdict is not out, it is clear that Gabeheart is confident that he was not involved in the sharing of any confidential information that would hamper JGR. He was an employee on the team for over a decade and had expressed frustration to Joe Gibbs over his personal role on the team as well.
